Who the Act applies to
The Fair Competition Act applies broadly to “enterprises”, defined as any person carrying on business in Jamaica, whether individually or through corporate structures (section 2). Enterprises include: partnerships, and other commercial actors engaged in the supply of goods or services.
The Act also covers “dealers” (persons supplying goods wholesale or retail) and “suppliers”, as well as consumers, defined as persons receiving goods or services outside the course of business (section 2).
What conduct is covered
The Act prohibits:
- Anti-competitive agreements including price fixing (section 34) and misleading advertising (section 37).
- Abuse of dominant position (sections 19-20)
- Resale price maintenance
- Exclusive dealing, tied selling and market restrictions where suppliers impose conditions limiting competition (section 33).
- Misleading and deceptive conduct including false advertising and misleading representation to consumers (sections 37-38).
- Other unfair practices.
Key terms
“Advertisement” means any form of communication made to the public or a section of the public for the purpose of promoting the supply of goods or services.
“Business” means any activity that is carried on for gain or reward or in the course of which goods or services are manufactured, produced or supplied, including the export of goods from Jamaica;
“Consumer” means any person who is either—
- (a) a person to whom goods are or are intended to be supplied in the course of a business carried on by the supplier or potential supplier;
- (b) a person for whom services are supplied in the course of a business carried on by the supplier or potential supplier,
and who does not seek to receive the goods or services in the course of a business carried on by him.
